Terms of Service
These Terms of Service (hereinafter referred to as "the Terms") set forth the terms and conditions for the use of the services provided by Aluna Co., Ltd. (hereinafter referred to as "the Company") through this website (hereinafter referred to as "the Service"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Applicability)
These Terms apply to all relationships between the User and the Company regarding the use of the Service. In addition to these Terms, the Company may establish various rules (hereinafter referred to as "Individual Regulations") for the use of the Service. These Individual Regulations, regardless of their name, shall be considered part of these Terms.
In the case of a conflict between these Terms and any Individual Regulations, the provisions of the Individual Regulations shall take precedence, unless otherwise specified.
Article 2 (Registration for Use)
To use the Service, a registration applicant must agree to these Terms and apply for registration using the method specified by the Company. Registration will be complete upon the Company's approval.
The Company may refuse to approve a registration application if the applicant has the following circumstances, and the Company has no obligation to disclose the reasons:
- The applicant has provided false information during the registration process.
- The applicant has previously violated these Terms.
- The Company deems the registration application inappropriate for any other reason.
Article 3 (Management of User ID and Password)
Users are responsible for appropriately managing their User ID and password for the Service. Users may not transfer, lend, or share their User ID and password with any third party under any circumstances. If the combination of User ID and password matches the registration information and the User logs in, the use will be considered as having been made by the User themselves.
The Company is not responsible for any damages caused by the use of the User ID and password by a third party, except in cases of the Company's intentional misconduct or gross negligence.
Article 4 (Usage Fees and Payment Methods)
Users shall pay the usage fees for the paid portion of the Service, as separately specified and displayed on the website, using the payment method designated by the Company.
If a User delays payment of the usage fees, they shall be required to pay a late fee of 14.6% per annum.
Article 5 (Prohibited Activities)
Users must not engage in the following activities while using the Service:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that infringe on intellectual property rights, such as copyrights and trademarks, included in the Service.
- Acts that destroy or interfere with the functionality of the Company's, other users', or third parties' servers or networks.
- Commercial use of information obtained from the Service.
- Acts that disrupt the operation of the Service.
- Unauthorized access or attempts to do so.
- Collection or accumulation of personal information about other users.
- Use of the Service for improper purposes.
- Acts that cause inconvenience, damage, or discomfort to other users or third parties.
- Impersonating other users.
- Unauthorized advertising, solicitation, or business activities on the Service.
- Activities aimed at meeting strangers of the opposite sex.
- Directly or indirectly providing benefits to antisocial forces in connection with the Service.
- Any other activity the Company deems inappropriate.
Article 6 (Suspension of Service)
The Company may suspend or interrupt the provision of the entire Service or part of it without prior notice to the User, if any of the following occurs:
- Maintenance or updates of the computer system for the Service.
- Force majeure events such as earthquakes, lightning, fires, power outages, or natural disasters that make it difficult to provide the Service.
- System failures due to accidents involving computers or communication lines.
- Any other reason the Company deems it difficult to provide the Service.
The Company is not responsible for any inconvenience or damage caused to the User or third parties due to the suspension or interruption of the Service.
Article 7 (Restriction of Use and Cancellation of Registration)
The Company may restrict a User's access to the Service or cancel their registration without prior notice if the User falls under any of the following conditions:
- Violates any of the provisions of these Terms.
- The User is found to have provided false registration information.
- The User fails to pay fees or obligations.
- The User does not respond to the Company's contact within a reasonable period.
- The User has not used the Service for a certain period.
- The Company deems the User's use of the Service inappropriate.
The Company is not responsible for any damage caused to the User due to actions taken under this article.
Article 8 (Withdrawal)
Users may withdraw from the Service by following the withdrawal procedure specified by the Company.
Article 9 (Disclaimer and Limitation of Liability)
The Company does not guarantee that the Service is free from any defects, including but not limited to safety, reliability, accuracy, completeness, validity, suitability for a particular purpose, security, errors, bugs, or rights infringement.
The Company is not responsible for any damages arising from the use of the Service, except in cases of intentional misconduct or gross negligence. However, this limitation of liability does not apply to consumer contracts as defined under the Consumer Contract Act.
Even in the cases specified in the preceding paragraph, the Company is not responsible for any special damages resulting from the Company's negligence (except in cases of gross negligence).
The Company is not responsible for any transactions, communications, or disputes that arise between Users or between a User and a third party.
Article 10 (Changes to the Service)
The Company may change, add, or discontinue the content of the Service with prior notice to Users, and Users agree to this.
Article 11 (Changes to the Terms)
The Company may change these Terms without individual consent from Users under the following circumstances:
- When the change is in the general interest of Users.
- When the change is reasonable in light of the objectives of the Service and the necessity of the change.
The Company will notify Users in advance about any changes to the Terms, the contents of the changes, and the effective date.
Article 12 (Handling of Personal Information)
The Company will handle personal information obtained through the use of the Service in accordance with its Privacy Policy.
Article 13 (Notifications or Communications)
Notifications or communications between the User and the Company will be made using the methods specified by the Company. The Company considers any contact made to the currently registered contact information valid, unless otherwise notified by the User.
Article 14 (Prohibition of Assignment of Rights and Obligations)
Users may not assign or pledge their rights or obligations under these Terms to any third party without prior written consent from the Company.
Article 15 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any disputes arising in relation to the Service shall be subject to the exclusive jurisdiction of the court where the Company's head office is located.
